Aircraft - Experimental Light-Sport Aircraft (ELSA)

Can I be instructed in my own aircraft for the Sport Pilot certificate if it is registered as an experimental homebuilt? I am confused as to the 31 Jan 2010 statement that is out there. I believe the answer is yes but I want to make sure so I don't have any problems when it comes time to go and take the checkride.
Can I earn a repairman certificate to maintain a standard category aircraft that meets the definition of an LSA?
Your information is not accurate with regards to Sport pilot privileges and aircraft weight limits. The only “official” defining weight limit is “Maximum Takeoff Weight”.

As you know, the definition of “light sport aircraft” is found in FAR 1.1

Light-sport aircraft means an aircraft, other than a helicopter or powered-lift that, since its original certification, has continued to meet the following:
(1) A maximum takeoff weight of not more than—
(i) 1,320 pounds (600 kilograms) for aircraft not intended for operation on water; or
(ii) 1,430 pounds (650 kilograms) for an aircraft intended for operation on water.

The FAA realized it needed to, and did, include the definition of “maximum takeoff weight” as it applies to the LSA definition in 1.1 and it is found on page 44793 of the Federal Register;

Certification of Aircraft and Airman for the Operation of Light-Sport aircraft; Final Rule. Dated July 27, 2004
It says, verbatim,

"Some commentators stated that lacking a definition of maximum take off weight, aircraft with fairly high performance characteristics could meet the definition of light-sport aircraft by limiting the approved weight and payload of the airplane. The FAA considers this a valid concern and has provided some additional constraints on the weight as detailed below. The maximum weight of a light-sport aircraft is the sum of :
(1) Aircraft empty weight;
(2) Weight of the passenger for each seat installed;
(3) Baggage allowance for each passenger; and
(4) Full fuel, including a minimum of the half hour fuel reserve required for day visual flight rules in FAR 91.151(a)(1)"

This definitively states the definition of ”maximum takeoff weight” of a light-sport aircraft as is used to determine what may be considered a light sport eligible aircraft and no other definition, or use of the term “maximum weight” as found in the F.A.R’s or elsewhere may be substituted at will. Not Gross weight, Maximum Gross weight, Maximum gross takeoff weight, or any of the other terms that are tossed around. This weight, “maximum takeoff weight”, as defined specifically by the FAA for LSA issues, as the sum of (1), (2), (3), and (4),

A Kitfox Series 5, with an empty weight of 710 lbs (1) with both seats filled (2), and, full fuel tanks (3), still leaves 63 pounds of for baggage allowance as required by (4)

Seats filled 2 x 180 = 360 lbs
Full tanks (inc header) 27 gal. x 6 lbs = 162 lbs
Empty weight as on current W&B = 710 lbs.
1232 lbs
Baggage allowance 25 lbs
1257 lbs as weighed and loaded

Weight at time of takeoff is 63 lbs LESS THAN 1320 lbs.
Note: In this loading configuration the aircraft is well within it’s demonstrated and published flight envelope

AND, the aircraft has not been altered or modified since it was issued it’s airworthiness certificate, in order to meet the definition.
Example: The fuel capacity has not been modified to lower the weight of (4) “full fuel.” as a result of installing smaller tanks.

Therefore, it has met the condition “since its original certification, has continued to meet the following:
1) A maximum takeoff weight of not more than… (add (1), (2), (3), and (4) (1320lbs max. land use) has been met

One pilot may, under Sport pilot privileges, operate the aircraft at “maximum takeoff weight” up to 1320 lbs, another pilot flying under private pilot privileges, up to the design weight, in this case 1400 lbs. Same aircraft.

One must read and understand the Final Rule and apply it correctly to the regulation it governs. I would look forward to any comments or corrections.
I am a CFI. My student has necessary experience for light sport license and I find him competent and proficient in his LSA Taylorcraft. Now he wants a checkride with an examiner but the examiner will have to be 100 lbs or less to remain under gross weight (with 1.5 hrs fuel). Can he use a cessna 150 (not LSA) for his Sport Pilot checkride?

As a soon to be sport pilot in the US, I am trying to determine if used Murphy Elite, Rebel, Renegade Spirit, Maverick meet the following requirements:

*Its country of origin must have a bi-lateral agreement with the Federal Aviation Administration.
*The aircraft must be eligible to operate in its country of origin.
*The aircraft must meet the consensus standards developed by the ASTM industry group and accepted by FAA.

I have come across a few that have N numbers, but can't tell if I will be legal if I buy one. If you can provide an answer or better yet, a link to the answers, I would appreciate it much.
Wag-aero claims that their Cuby is LSA legal, but you do not list it as an elgible aircraft. How do you view it's status.
I am a retired military pilot. After about 18 years of not flying I decided to try trikes under the Sport Pilot program. That went nowhere because of so few FAA recognized instructors/evaluators in weight shift. I talked to one trike manufacturer at the recent NWEAA Fly In and he said numerous trike pilots are returning to their ultralights because the Sport Pilot program isn't working out for them.

The instructors I have met apparently come from the ultralight school. We had an altimeter because the field is sandwiched between legs of the GA pattern and there are altitude restrictions. What bothered me some was no airspeed indicator. If a weight shift aircraft is licensed wouldn't it have to have an airspeed indicator to meet the minimum instrument requirements? Also wouldn't the training from an instructor from the ultralight community thus be different from one with FAA qualification as a weight shift instructor? (The instructor I had didn't seem to think there was any particular value in having airspeed.) I've flown thousands of hours in helicopters and could probably get along much of the time without an airspeed indicator but that doesn't mean I didn't use one, even flying VFR. There are many times refering to instruments is useful and helps you be more precise and in control.
Can you kindly provide me a listing of all two-place, tricylce gear, enclosed cockpit aircraft, standard and experimental, which meet the Light Sport Aircraft category?
I have an AirBorne trike with a rectifier for 12 volt powered accessories. Does this require me to have to install a mode C transponder to land at an airport underneath class B, but within the 30 mile veil? I did not know if any ELSA with a Rotax / rectifier constituted "an aircraft with an engine-driven electrical system"
What is an Experimental Light-Sport Aircraft (E-LSA)?

The weight limitation in FAR 1.1 is "maximum takeoff weight" and is defined in the Final Rule 'Federal Register / Vol. 69, No. 143 / Tuesday, July 27, 2004 / Rules and Regulations' as:

"The maximum weight of
a light-sport aircraft is the sum of:
(1) Aircraft empty weight;
(2) Weight of the passenger for each
seat installed;
(3) Baggage allowance for each
passenger; and
(4) Full fuel, including a minimum of
the half-hour fuel reserve required for
day visual flight rules in § 91.151(a)(1)."

Please cite your source to justify your repeated use and substitution of the words "gross weight".

In one question weight was discussed at length. I understand that the maximum takeoff weight of 1320 or 1430 lbs for seaplanes has to be continuously met.

1) What if the specific aircraft is only certificated to 1225 lbs. Would its E-LSA registration be revoked if at one day the TO weight was a bit more, say 1250 or 1300 lbs, or only if it was to exceed 1360 or 1410 lbs?

2) I did not understand the weight taken for the pilot and the passenger of 180 lbs. What is that number used for?

If you qualify as a sport pilot you may fly either a LSA or AB-EXP registered airplane (so long as the AB-EXP qualifies). Correct? So what are the advantages/disadvantages of registering a plane as LSA v.s. AB-EXP? If I'm a private pilot and want to build an airplane that would qualify as LSA is there any reason I would want to go AB-EXP? Which certification is easier?

I have been taking lessons in a Cessna 172 and have been endorsed to solo. I have a current 3rd medical.
I have also just completed the registration and airworthiness of my Quicksilver GT400 (single seat aircraft)
I want to be able to fly off the Phase One hours in the GT400.

Can my CFI endorse me to solo my GT400 based upon the instruction given in the Cessna?
Can I solo anywhere? at any time?
Can I fly off the Phase one hours as a student pilot, endorsed to solo in a Cessna?

What is required to be endorsed to fly the Registered single seat GT400 as a student pilot? My CFI (gold seal instructor) has already logged the endorsement, but I want to be sure it's correct.
I Hold an A&P rating, but don't work full time in the this field, so I don't meet the part 65.83 experience requirements.
I do meet the part 65.81 requirements since I do a large share of the maintenance on ultralights for our local club. Does my A & P rating give me any privileges to perform annual condition inspections or maintenance on ELSA?
What is the document that the FAA has on file which shows the empty and gross weights?
Does EAA offer any Repairman Certificate-Inspection courses?

I have a Corby CJ-1 powered by a 1679cc VW engine.
It is currently registered as an expermintal and has an "N" number. Can it be registered as an E-LSA?
I have a freind that has a UFM-13 Lanbada and in his book it has rlsa-m for sign off on 25 hr inspections. What does it stand for
Do you have a list by state for MI & FL of individuals who can perform or legally sign off on required annual inspections for ELSA? If so, where?
thank you in advance.
Does a E-LSA Kit airplane have to built strictly to the plans or can it be modified and still be certified as a E-LSA. For example, different radios, instrumentation, adding fuel injection, etc.
when is an LSA offically n-numbered when you apply for it or when you receive it?
What is involved in getting a PPC approved/certificated to be qualified as an E-LSA or SLSA after the Jan. 2008 deadline. This would be for a currently produced German design.
I am interested in purchasing an RV9 that has been issued an ELSA airworthy certificate. Could the FAA rescind the airworthiness certificate as the airplane has been very controversial.
I am looking into purchasing an aircraft. It is a model which would meet the LSA requirements, however it seems that it was previously registered as an experimental amateur-built aircraft. The previous registration was cancelled, with the reason as "destroyed". But the current owner tells me it is the same plane. Could this aircraft be registered as an E-LSA now.
I understand that conversion of "Fat" Ultralight aircraft it E-LSA has expired. How about building an LSA? Still possible?
If my plane falls into the ELSA requriments can I fly it under the light sport rules using a max weight of 1320. Even though I regester it experemental amateur-built with a gross weight of 1510
What is the final rule regarding the use of amphibious floats (in flight repositionable landing gear) with the new sport pilot license.
As more and more weight-shift (trikes) aircraft become "N" numbered the call signs at some of the airports is becoming confusing. We used to be call the tower as "Ultralight Trike 101JP" or whatever number you made up. Now with an "N" number I have heard call signs such as "Experimental Trike 5248A", "Light Sport Trike 5248A" and the grandaddy, "Experimental Light Sport Trike 5248A" According to the AIM, using a Breezy, (4.2.4) it "seems" that the aircraft call sign should be "Sabre 5248A Experimental" but I doubt many controllers will know what a Sabre is much less a Tukan or Northwing, etc. Any thoughts on this?
I recently purchased an aircraft that was certificated as E-LSA over a year ago. I just read the fine print in the Operating Limitations which state that it is not supposed to be flown over congested areas. How do I get this part of the operating limitations changed to allow flight over congested areas.
I thought I heard that manufacturers would be able to offer E-LSA kits that require less than 51% builder completion (For example could you purchase a kit from "X" kit company at 85%, complete the remaining 15% and register it as an E-LSA). Is this true or did that proposal not make it into the final rule?
I was considering buying a used Thorp T-211, built as a kit with a continental 0-200 engine, assuming that this would meet the LSA standards as Light sport, since there is an SLSA version of the same plane, using the Jabiru 3300 engine. But.. I think the kit version doesn't qualify due to the high stall speed.
This page http://www.indusav.com/info.html shows a stall speed of 52kts, but another page (http://www.indusav.com/Images/T211%20Specs.pdf) shows a clean stall of 45 kts.
During Sun N Fun, the FAA announced a number of changes to the Sport Pilot/Aircraft rules. One was with regards to maintenance of E-LSA aircraft. Your website states the following: "Removal of the requirement for aircraft certificated as experimental light-sport aircraft (E-LSA) to comply with the Part 43 maintenance regulations. This means E-LSA can now be maintained like other experimental aircraft." Does this mean that the 16 hour course and exam are no longer required for a builder/owner of an E-LSA to perform annual inspections (including new E-LSA like Vans RV-12)?
Can a properly certificated pilot (3rd class medical, etc.) legally fly IFR in a properly (IFR) equipped ELSA?

Am I to understand that I will need 16 hours of instruction in order to maintain my homebuilt E-LSA?
Can a sport pilot fly an "experimental/exhibition" aircraft?
Where do I find the chart (old figure 3.1 of chapter 3, AC 43-13) that gives the acceptable minimum strength requirements for organic covers for aircraft. I did a search of the FAA site under AC-13 and could not find it.
Why are helicopters not included in the definition of a light-sport aircraft?
What are the requirements of a Repairman Certificate-Inspection?
Hi, a friend owns a E-LSA. Can I legally borrow the a/c and fly it solo, and pay him by the flight-hour to help him pay for maintenance, etc.?

Same question but change E-LSA to Part 103 Ultralight.

Neither a/c is insured. Can I buy a non-owner policy to cover the a/c while I fly? I have Private Pilot cert. and current medical.
What would be the aprox. cost of liability insurance for a new pilot, on a new ELSA.
In regards to FAA registration, it would seem like the powered parachute 2 place kit, (in particular, the Sixchuter Spirit model), would fall under the 51% build rule and not have to be registered under Sport Pilot, but as amateur built. Am I correct?
how do I find out what my "N" number is?

I'm building a Just Aircraft Highlander kit that will fit the light sport aircraft requirements. My question is how should I register it. Experimental amateur built, or experimental light sport aircraft. Other than not having to take the repairman's course to do the annual inspection, what is the advantage or disadvantage of each?
I have a Team Hi-Max with at Kawasaki 440A engine. On the registration form it asks for the engine serial number. But the engine has no serial number on it. What should I put in on the form?
I believe the N-numbers on a sport pilot airplane must be 3 inches. Is that correct? Must they be displayed on both sides of the plane? Any specific location required?
Can I use an "X" in front of the "N" number and not have to put the experimental on the cabin? If I have to use the "Experimental", is it required on both Left and Right side of airplane?
Flying a 2-seat trike in the past, I have announced myself on the radio as "ultralight trike" so people would know what to look for. Now that the trike is registered as an LSA, how should I announce? Eg. "Light Sport Trike N5061J"? Antares weightshift N5061J"? Hardly anyone would know what Antares is and I am afraid a lot of GA pilots won't know what to look for with "weightshift". At least with "ultralight" they would know 'looks weird and flies slow'.
hello, I'm looking at a Phantom with N #, starter, handheld but no transponder or mode C. I want to base it at X21, a couple miles inside Orlando 30 mile radios? Is transponder and/or mode C required?

What are the phase 1 requirements for ESLA flight testing of a newly constructed aircraft?
Would you list the prohibited medications, if any, for operating an E-SLA?
I bought a factory built Slepcev storch and it will show up in Houston TX in 4 weeks. Do I need to hire a broker to get the airplane through customs or can I show up with the bill of sale and pick it up myself?
What are the rules about building an E-SLA with a gross weight over 1320lbs.(say 1500lbs.) but flying it at or under 1320lbs. to stay withing the Sport Pilot catagory? There are more than one manufacturer of kit planes implying you can do this in their advertising.
I am a CFI and I am considering re-certifying my S-LSA as an E-LSA for a number of reasons. Afterwards, will I be able to offer flight instruction to family members, without compensation, in this airplane once its airworthiness is as an E-LSA? Will it require 100 hr inspections under these conditions (or only offer the flight instruction within 100 hrs of its annual condition inspection)? If so, would I, as a possessor of a Repairman-Inspection certificate, be able to perform the inspections?
I have friends with ultralights who have missed the deadline for ELSA conversion. What is the procedure post-conversion period? Can they register as ELSAs and get their airworthiness inspection done - as any experimental or amateur-built would?
If an E-LSA is jointly owned may any of the owners receive flight instruction in the same aircraft?
Can I fly my friends ELSA Rans S 9 in Germany? Is my german PPL-C and B validationable for this aircraft? Is aerobatic allowed with ELSA aircraft?

I have a Rotax 912S installed in my ELSA aircraft and would like to know if there is a Reotax engine service center near where I live in Central Texas.
Hi, I'm having trouble finding the correct answer and reading 14 CFR Part 43 only confuses me more. If I build an E-LSA then what modifications can I make to it as the owner/builder?

Some "experts" I've say I can do any mods I want, others say, regarding repairing/modifying, that to remain an E-LSA, the builder must not deviate from the manufacturer’s certificated specifications. If there is deviation, the aircraft becomes an amateur built experimental.

My understanding is there is no general distinction regarding the modification/alteration question between E-LSA and Experimental Amateur Built Category. True or not? Hope you can clear this up, thank you.
Are rotorcraft allowed in the LSA classification?
I am a 200+ hour trike pilot that has a SP license and has my trike ELSA registered with the FAA.

I have a non-profit group that I support often. Recently the director and I were discussing the oppotunity for me to donate a short flight in my ELSA trike to a silent auction at an upcoming fundraiser in May. I told them that I would look into it but could swear that I remember seeing some sort of official FAA rule that specifically forbids doing something like this with SP and ELSA. Am I out of luck or is there some way that I can donate a short flight to raise some money for this non-profit?
May the holder of a private pilot SEL rating fly the ELSA plane at night?
I am in the process of concieving and designing an E-LSA single seat aerobatic airplane. It will be "Laser Like" but built lighter with a different wing and powerplant/propeller to fit within the envelope of the LSA rule. I got my private pilot certificate (asel) in 2005. Last year i bought an x-air H (registered experimental), learned to fly it with a friend (not an instructor) and have about 25 hours in it now. I just reread the experimental operating limitations that came with the H. It says "the pic of this aircraft must hold at least a student pilot certificate with asel, AND a x-air H make/model privilege endorsement by an authorized instructor". With the (asel) private pilot certificate, do i still need the endorsement from an x-air instructor ?

HI. Suppose that, at some time in the next year or two, I buy/build a Part 103-legal single-seat ultralight. But then I add stuff so it weighs more than 254 lbs, can I apply for an ELSA airworthiness certificate?
I have had people tell me that once an E-LSA is built the owner can do any mods without manufacturer approval so long as the aircraft still complies with the definition of LSA. I have also been told that if an E-LSA is modified to the extent it no longer complies with the definition of LSA (say by a new prop that increases the speed), even if it is re-modified to comply with LSA standards, it cannot be flown as an LSA.

Where are the rules that address these and similair issues?

Hello, I am currently in the process of buying an aircraft that fits the LSA catagory.Because it was advertised in the LSA section of barnstormers and fits the bill I assumed it was registered ELSA. The seller (after I agreed to buy the plane) told me it was registered Experimental. I assume he meant EAB. I said I needed an ELSA as I am a Sport pilot with an inspection repairman certificate. He said it didn't matter as long as the aircraft fits the LSA rules, which it does ,it's a Super Hornet. After reading a few questions and answers here I've discovered that I will be unable to do my own annuals on the plane. Am I correct? and if so Can an EAB be changed to an ELSA the way an SLSA can be?....Or will I be stuck having to pay an A&P to do all of the annuals on the plane?

Who determines if an aircraft can be flown by a sport pilot? If an aircraft is being flown as an experimental and received its airworthy cert before there was a lsa catagory, can it receive an lsa airworthy cert if it meets lsa criteria?
The answer is most likely NO. But I will ask anyway. Is there any waiver available for an aircraft that is only 50 to 60 lbs. over the MGW limit for ELSA ? The empty weight is 900 lbs.. With two at 170 = 340 lbs and full fuel - 22 gal at 6 lbs you get a total weight of 1373 lbs. So close but no cigar .

If you build a Kitplane (I.E. Vans RV-7 Etc. . How come you can be giving a repairmans certificate...but if you build an E-LSA, you have to attend a course (120 Hours) to maintain it???
