Can I be instructed in my own aircraft for the Sport Pilot certificate if it is registered as an experimental homebuilt? I am confused as to the 31 Jan 2010 statement that is out there. I believe the answer is yes but I want to make sure so I don't have any problems when it comes time to go and take the checkride.
Can I earn a repairman certificate to maintain a standard category aircraft that meets the definition of an LSA?
Your information is not accurate with regards to Sport pilot privileges and aircraft weight limits. The only “official” defining weight limit is “Maximum Takeoff Weight”.

As you know, the definition of “light sport aircraft” is found in FAR 1.1

Light-sport aircraft means an aircraft, other than a helicopter or powered-lift that, since its original certification, has continued to meet the following:
(1) A maximum takeoff weight of not more than—
(i) 1,320 pounds (600 kilograms) for aircraft not intended for operation on water; or
(ii) 1,430 pounds (650 kilograms) for an aircraft intended for operation on water.

The FAA realized it needed to, and did, include the definition of “maximum takeoff weight” as it applies to the LSA definition in 1.1 and it is found on page 44793 of the Federal Register;

Certification of Aircraft and Airman for the Operation of Light-Sport aircraft; Final Rule. Dated July 27, 2004
It says, verbatim,

"Some commentators stated that lacking a definition of maximum take off weight, aircraft with fairly high performance characteristics could meet the definition of light-sport aircraft by limiting the approved weight and payload of the airplane. The FAA considers this a valid concern and has provided some additional constraints on the weight as detailed below. The maximum weight of a light-sport aircraft is the sum of :
(1) Aircraft empty weight;
(2) Weight of the passenger for each seat installed;
(3) Baggage allowance for each passenger; and
(4) Full fuel, including a minimum of the half hour fuel reserve required for day visual flight rules in FAR 91.151(a)(1)"

This definitively states the definition of ”maximum takeoff weight” of a light-sport aircraft as is used to determine what may be considered a light sport eligible aircraft and no other definition, or use of the term “maximum weight” as found in the F.A.R’s or elsewhere may be substituted at will. Not Gross weight, Maximum Gross weight, Maximum gross takeoff weight, or any of the other terms that are tossed around. This weight, “maximum takeoff weight”, as defined specifically by the FAA for LSA issues, as the sum of (1), (2), (3), and (4),

Example:
A Kitfox Series 5, with an empty weight of 710 lbs (1) with both seats filled (2), and, full fuel tanks (3), still leaves 63 pounds of for baggage allowance as required by (4)

Seats filled 2 x 180 = 360 lbs
Full tanks (inc header) 27 gal. x 6 lbs = 162 lbs
Empty weight as on current W&B = 710 lbs.

1232 lbs
Baggage allowance 25 lbs
--------------------
1257 lbs as weighed and loaded

Weight at time of takeoff is 63 lbs LESS THAN 1320 lbs.
Note: In this loading configuration the aircraft is well within it’s demonstrated and published flight envelope

AND, the aircraft has not been altered or modified since it was issued it’s airworthiness certificate, in order to meet the definition.
Example: The fuel capacity has not been modified to lower the weight of (4) “full fuel.” as a result of installing smaller tanks.

Therefore, it has met the condition “since its original certification, has continued to meet the following:
1) A maximum takeoff weight of not more than… (add (1), (2), (3), and (4) (1320lbs max. land use) has been met

One pilot may, under Sport pilot privileges, operate the aircraft at “maximum takeoff weight” up to 1320 lbs, another pilot flying under private pilot privileges, up to the design weight, in this case 1400 lbs. Same aircraft.

One must read and understand the Final Rule and apply it correctly to the regulation it governs. I would look forward to any comments or corrections.
I am a CFI. My student has necessary experience for light sport license and I find him competent and proficient in his LSA Taylorcraft. Now he wants a checkride with an examiner but the examiner will have to be 100 lbs or less to remain under gross weight (with 1.5 hrs fuel). Can he use a cessna 150 (not LSA) for his Sport Pilot checkride?

Wag-aero claims that their Cuby is LSA legal, but you do not list it as an elgible aircraft. How do you view it's status.
I am a retired military pilot. After about 18 years of not flying I decided to try trikes under the Sport Pilot program. That went nowhere because of so few FAA recognized instructors/evaluators in weight shift. I talked to one trike manufacturer at the recent NWEAA Fly In and he said numerous trike pilots are returning to their ultralights because the Sport Pilot program isn't working out for them.

The instructors I have met apparently come from the ultralight school. We had an altimeter because the field is sandwiched between legs of the GA pattern and there are altitude restrictions. What bothered me some was no airspeed indicator. If a weight shift aircraft is licensed wouldn't it have to have an airspeed indicator to meet the minimum instrument requirements? Also wouldn't the training from an instructor from the ultralight community thus be different from one with FAA qualification as a weight shift instructor? (The instructor I had didn't seem to think there was any particular value in having airspeed.) I've flown thousands of hours in helicopters and could probably get along much of the time without an airspeed indicator but that doesn't mean I didn't use one, even flying VFR. There are many times refering to instruments is useful and helps you be more precise and in control.

Our club is trying to determine which of its gliders can be flown at sport pilot. They both meet the weight limits, but we were wondering about the top speed criteria. What speed is used to determine which gliders qualify? Vne does not seem appropriate, since other sport planes have vne higher than 120kts.

In one question weight was discussed at length. I understand that the maximum takeoff weight of 1320 or 1430 lbs for seaplanes has to be continuously met.

Questions:

1) What if the specific aircraft is only certificated to 1225 lbs. Would its E-LSA registration be revoked if at one day the TO weight was a bit more, say 1250 or 1300 lbs, or only if it was to exceed 1360 or 1410 lbs?

2) I did not understand the weight taken for the pilot and the passenger of 180 lbs. What is that number used for?

I'm brand new to aviation and am building a Groen Brothers Sparrowhawk Gyroplane kit. I need to plan the control panel so I need to make some decisions about what avionics I will add. The kit comes with an EFIS but I know i will also need a Mode C Transponder and a radio. As I look at radio equipment in catalogs, I get really confused. I don't know the difference between NAV/COMM, Transcievers, and VHF Radios. If I'll only be flying VFR, which do I need and what is the difference?

Can I fly the PPC at night in accordance with 91.205 as listed in my operating limitations, or do I need a PPC CFI (not just sport pilot CFI) to gain night privileges in the PPC?

I bought a gyroplane from an individual. He didn't want to sell it as a flying aircraft with an N number. He removed the numbers and I signed a bill of sale for parts and releasing him from any liability. No mention of the type of aircraft, serial number or N number was noted. Just his name, my name & dated. Can I register it as an ELSA? He won't transfer the the ownership using the N number. Or, can I simply apply for the transfer without his signed FAA form?

When filling out the application for registration, the first line asks for US Identification. I have a reserved N number but I'm not sure if this is what that question refers to.
I would like to build a J3 replica on floats and license it ELSA. I presume I can register the gross weight at 1430 lbs. My question is, if I decide to remove the floats and put it on wheels, can I still fly it at the registered 1430 1bs or am I restricted to 1320 lbs?

As more and more weight-shift (trikes) aircraft become "N" numbered the call signs at some of the airports is becoming confusing. We used to be call the tower as "Ultralight Trike 101JP" or whatever number you made up. Now with an "N" number I have heard call signs such as "Experimental Trike 5248A", "Light Sport Trike 5248A" and the grandaddy, "Experimental Light Sport Trike 5248A" According to the AIM, using a Breezy, (4.2.4) it "seems" that the aircraft call sign should be "Sabre 5248A Experimental" but I doubt many controllers will know what a Sabre is much less a Tukan or Northwing, etc. Any thoughts on this?
I recently purchased an aircraft that was certificated as E-LSA over a year ago. I just read the fine print in the Operating Limitations which state that it is not supposed to be flown over congested areas. How do I get this part of the operating limitations changed to allow flight over congested areas.
I thought I heard that manufacturers would be able to offer E-LSA kits that require less than 51% builder completion (For example could you purchase a kit from "X" kit company at 85%, complete the remaining 15% and register it as an E-LSA). Is this true or did that proposal not make it into the final rule?
I was considering buying a used Thorp T-211, built as a kit with a continental 0-200 engine, assuming that this would meet the LSA standards as Light sport, since there is an SLSA version of the same plane, using the Jabiru 3300 engine. But.. I think the kit version doesn't qualify due to the high stall speed.

Flying a 2-seat trike in the past, I have announced myself on the radio as "ultralight trike" so people would know what to look for. Now that the trike is registered as an LSA, how should I announce? Hi, I'm having trouble finding the correct answer and reading 14 CFR Part 43 only confuses me more. If I build an E-LSA then what modifications can I make to it as the owner/builder?

Some "experts" I've say I can do any mods I want, others say, regarding repairing/modifying, that to remain an E-LSA, the builder must not deviate from the manufacturer’s certificated specifications. If there is deviation, the aircraft becomes an amateur built experimental.

My understanding is there is no general distinction regarding the modification/alteration question between E-LSA and Experimental Amateur Built Category. True or not? Hope you can clear this up, thank you.

I just reread the experimental operating limitations that came with the H. As a current Sport Plot, can I purchase an aircraft that was used as an ultralight before the new rules came out, (but no longer meets part 103 limits) and register it as experimental LSA?

I saw it written (AOPA?) that an E-LSA that was built by yourself, can be used for instruction for compensation. Is that correct? ( Beyond the Jan 2010 date that is )
I also understand that you may instruct for compensation for an owner of an E-LSA in their aircraft.

HI. Suppose that, at some time in the next year or two, I buy/build a Part 103-legal single-seat ultralight. But then I add stuff so it weighs more than 254 lbs, can I apply for an ELSA airworthiness certificate?
I have had people tell me that once an E-LSA is built the owner can do any mods without manufacturer approval so long as the aircraft still complies with the definition of LSA. I have also been told that if an E-LSA is modified to the extent it no longer complies with the definition of LSA (say by a new prop that increases the speed), even if it is re-modified to comply with LSA standards, it cannot be flown as an LSA.

Where are the rules that address these and similair issues?
Is there any way to allow an LSA to have a rotary engine such as a Wankel, or to allow an SP to fly an experimental that has one??? My reading says "reciprocating" only and I think it should read "powerplant" or ?? Maybe a waiver or?

Hello, I am currently in the process of buying an aircraft that fits the LSA catagory.Because it was advertised in the LSA section of barnstormers and fits the bill I assumed it was registered ELSA. The seller (after I agreed to buy the plane) told me it was registered Experimental. I assume he meant EAB. I said I needed an ELSA as I am a Sport pilot with an inspection repairman certificate.He said it didn't matter as long as the aircraft fits the LSA rules,which it does ,it's a Super Hornet. After reading a few questions and answers here I've discovered that I will be unable to do my own annuals on the plane. Am I correct? and if so Can an EAB be changed to an ELSA the way an SLSA can be?....Or will I be stuck having to pay an A&P to do all of the annuals on the plane?

The answer is most likely NO. But I will ask anyway. Is there any waiver available for an aircraft that is only 50 to 60 lbs. over the MGW limit for ELSA ? The empty weight is 900 lbs.. With two at 170 = 340 lbs and full fuel - 22 gal at 6 lbs you get a total weight of 1373 lbs. So close but no cigar .

If you build a Kitplane (I.E. Vans RV-7 Etc. . How come you can be giving a repairmans certificate...but if you build an E-LSA, you have to attend a course (120 Hours) to maintain it???
